Official Rules
- No Purchase Necessary. You may enter one of two ways: (a) To enter online: Navigate the Internet to www.vivadivacafe.com and click onto the Sweepstakes link to be connected to the Official Entry Form. Complete all the requested information and follow the instructions to enter online. (b) To enter via mail: On a 3” x 5” piece of paper hand-print your name, complete address and date of birth and mail in an envelope with proper postage to: VIVA® Diva Getaway Sweepstakes, P.O. Box 736, North Branford, CT 06471. Mailed entries must be postmarked by June 14, 2008, and received by June 21, 2008. Online entries must be transmitted and received by 11:59 p.m. CT on June 14, 2008. Limit one (1) entry per person and per email address per day. Multiple daily entry attempts from the same person will be rejected.
- Validations: Winner will be selected at random on or about June 23, 2008 by an independent judging organization, whose decisions are final on all aspects of the Sweepstakes. Entrants agree to be bound by these Rules. Potential winner will be notified by overnight express or regular mail and may be required to sign, notarize and return within 10 days of delivery to his/her address an Affidavit of Eligibility, a Prize/Travel and Publicity Release. Failure to comply when requested may result in disqualification and the selection of an alternate winner. Grand Prize travel companion also must sign a travel release. No responsibility is assumed for lost, late, postage due, stolen or misdirected mail or entries, or any failure or unavailability of electronic communications or Internet connections. If for any reason the sweepstakes, including the online portion, is not capable of running as planned, including disruptions caused by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other cause that corrupts, affects or compromises the administration, security, fairness, integrity, proper conduct or intended play of the sweepstakes, Sponsor reserves the right at its sole discretion to disqualify any individual Sponsor deems responsible and Sponsor further reserves the right to cancel, terminate, modify or suspend the sweepstakes, and randomly select winner from valid entries received. No responsibility is assumed for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications failure, theft, destruction or unauthorized access to, or alteration of, entries, including any erroneous appearance of qualification for a prize. No responsibility is assumed for any problem or technical malfunction of any telephone network or lines, computer online systems, servers or provider, computer equipment, software, failure of any e-mail or entry to be received by Sponsor due to technical problem or traffic, congestion on the internet or at any Web site, or any combination thereof, including any injury or damage to participant's or any other person’s computer related to or resulting from participation or downloading any materials in this sweepstakes. WARNING: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Sweepstakes entries generated by a script, macro or other mechanical or automated means are ineligible and will be disqualified. In the event of dispute as to the identity or eligibility of a winner based on an e-mail address, the winning entry will be declared made by the “Authorized Account Holder” of the e-mail address submitted at the time of the entry. The “Authorized Account Holder” is the person to whom the applicable Internet service provider or other organization (such as business or educational institution) has assigned the e-mail addresses for the domain associated with the submitted e-mail address. Entries void if incomplete, not legible, or if they contain errors. All submissions become property of Kimberly-Clark Global Sales, LLC., 2100 Winchester Road, Neenah, WI (“Sponsor”). By entering, entrants grant Sponsor permission to use their name and likeness for advertising or publicity without further compensation, unless prohibited by law.
- Participation: Sweepstakes begins 12:01 a.m. CT April 14, 2008, ends 11:59 p.m. CT June 14, 2008 and is open to legal residents of the 50 United States or D.C., 21 years of age or older. Employees, and members of their immediate families and households, of Sponsor, its subsidiaries, affiliated companies, advertising and promotion agencies and anyone else involved in the production, development or handling of this Sweepstakes are not eligible. Void in Puerto Rico and where prohibited. Subject to all applicable laws.
- Prize/Odds: The following prize will be awarded: One (1) Grand Prize: A trip for two (2) to Newport, Rhode Island for the Newport Mansions Wine & Food Festival on September 25 – 28, 2008. Prize consists of round-trip coach air transportation for winner and guest between Providence, RI and major airport in U.S. nearest winner’s home, 5 days/4 nights double occupancy hotel accommodations, mid-sized rental car for 5 days, two (2) Admission Tickets to select events including 2 tickets to the Gala, two tickets to the Grand Tasting and admission to Roseann Tully’s (CEO of Intermezzo Magazine) Cooking Demo at the Newport Mansions Wine & Food Festival on September 25 – 28, and the opportunity for winner to perform as a Sous Chef with Roseann Tully, CEO of Intermezzo Magazine during a cooking demonstration during the event (approx. retail value $4,250.00, potential opportunity to perform as Sous Chef has no retail value apart from the rest of the trip; actual value may vary depending on departure city). If winner lives within 100 miles of Providence, RI, ground transportation may be substituted in lieu of air travel. No guaranty is made that winner’s participation in the cooking demonstration will occur; final decisions are made exclusively by Intermezzo Magazine. Winner or designated travel companion driver must meet standard age, credit and other requirements for rental car. If those requirements are not met, then that portion of the prize package only will be forfeited with no cash compensation. Gasoline, excess mileage and insurance are winner’s responsibility. A major credit card will be required at hotel check-in to cover any miscellaneous expenses. All travel dates and accommodations are subject to availability and change. Travel must be on one itinerary and must be taken between 9/25/08 and 9/29/08. In the event Grand Prize winner cannot travel within the travel guidelines of the Prize, Prize will be forfeited and an alternate winner will be selected. Odds depend upon number of entries received. Prize may not be transferred. If prize becomes unavailable, Sponsor reserves the right to substitute prize of equal or greater value. Taxes, meals, gratuities, and any expenses not listed above are responsibility of winner. Allow 4-6 weeks after validation for arrangement of receipt of prize. By participating in this sweepstakes and/or accepting the prize, winner agrees to release and hold sponsor and its affiliates and agencies harmless from any and all losses, damages, rights, claims and actions of any kind resulting from participating in this sweepstakes and/or acceptance, possession or use of any prize, including without limitation, personal injuries, death and property damage. By participating in this sweepstakes, participants agree to be bound by all the Official Rules of this sweepstakes.
- Prize Winner List: For name of Grand Prize winner, mail a self-addressed, stamped envelope to: VIVA® Diva Getaway Sweepstakes Winner, P. O. Box 735, North Branford, CT 06471 by 6/14/08.
